Agreement Between User and Hackathoner

Welcome to Hackathoner. The Hackathoner website (the “Site”) is operated by Taifun Kemerci (also written as Tayfun Kemerci), Paulinenstr. 23, 74076 Heilbronn, Germany (“Hackathoner”, “we”, “us” or “our”). Hackathoner is offered to you subject to your acceptance, without modification, of the terms, conditions and notices contained herein (the “Terms”). Your use of Hackathoner constitutes your agreement to all such Terms. Please read these Terms carefully and retain a copy for your reference.
 
 

Service Overview

Hackathoner is an educational self-study membership platform. Membership provides access to the Campuses, Business Paths, lessons, frameworks, templates, tools and other digital educational resources included in the Membership Tier selected at the time of purchase. All content is provided for educational and informational purposes only.
Memberships do not include coaching, mentor access, Campus Q&A, personalised business advice, implementation guidance, WhatsApp support, Zoom sessions, live teaching, a member community or other forms of individual or group educational support. Technical account support is available only for login, billing and platform-access issues.
Hackathoner is designed for individuals who choose to learn independently, evaluate opportunities for themselves and apply educational material at their own pace. Access to the services is limited to members who accept and adhere to these Terms.

 

 

Privacy

Your use of Hackathoner is subject to our Privacy Policy, which explains how we collect, use, store and protect personal data. By using the Site, you acknowledge the Privacy Policy. Where consent is required by applicable law, we process personal data only on the basis of that consent or another applicable legal basis described in the Privacy Policy.
 
 

Electronic Communications

Visiting Hackathoner or sending e-mails to us constitutes electronic communication. Where permitted by applicable law, you agree that agreements, notices, disclosures and other communications we provide electronically satisfy any legal requirement that such communications be in writing. This does not affect any mandatory consumer rights or information requirements that apply to you.
 
 

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your account. You are responsible for all activities carried out through your account unless unauthorised access results from a failure attributable to Hackathoner.
You must provide accurate and complete information during registration and keep your account information up to date. Please notify us promptly if you suspect unauthorised access to your account.
Hackathoner may refuse, suspend or terminate access to an account where reasonably necessary to protect the platform, enforce these Terms, prevent misuse or comply with applicable law. Any such action is subject to mandatory consumer rights and applicable law.
 
 

Membership and Payment

Your Hackathoner membership provides self-directed access to the Campuses, Business Paths, lessons, frameworks, templates, tools and other digital educational resources included in the Membership Tier selected at the time of purchase. Memberships do not include coaching, Campus Q&A, personalised business advice, implementation guidance, WhatsApp support, Zoom sessions, live teaching or a member community.
 
Billing: By subscribing to Hackathoner, you authorise us to charge your selected payment method the applicable membership fee in USD at the start of each billing cycle. You may select monthly or annual billing where available. All prices are displayed in US Dollars (USD). Applicable taxes may be added depending on your country of residence.

Prices are subject to change. Where required by applicable law, we will provide at least 30 days’ notice before a price change takes effect. If you do not agree to a new price, you may cancel your membership before the change takes effect.
We accept Visa, Mastercard, American Express and other payment methods displayed at checkout. All transactions are processed in USD.
 
EU Customers: If you are located in the European Union, applicable VAT may be added to your subscription price in accordance with EU VAT rules for digital services. Your invoice will reflect the applicable VAT rate for your country.

 

 
 

Cancellation Policy

You may cancel your membership at any time through your membership portal by updating your subscription settings. If you experience an account or billing issue that prevents you from doing so, you may contact technical support at support@hackathoner.com.
To avoid your next charge, cancellation must be completed before your next billing date. Upon cancellation, your access to the membership content will remain active until the end of the current paid billing period. No partial refunds are issued for unused portions of a billing period, subject to any applicable mandatory consumer rights.

 

 

Refund Policy

Because Hackathoner provides digital membership access, refunds are not offered as a general policy. Refund requests are reviewed individually in accordance with these Terms and any applicable mandatory consumer rights. No refund is guaranteed.

EU Consumer Rights

If you are a consumer located in the European Union, you may have statutory withdrawal rights under applicable consumer protection law. Where you request immediate access to digital content, any loss of a withdrawal right applies only where the required consent and acknowledgement have been obtained during checkout. Nothing in these Terms limits any mandatory consumer rights that apply to you.

 

Prohibited Transactions

Hackathoner does not provide services, membership access or other transactions to any person, entity, country or region where doing so would be prohibited by sanctions laws or regulations applicable to Hackathoner or the relevant transaction. This includes, where applicable, sanctions imposed by the European Union, the United Nations Security Council and the United States Office of Foreign Assets Control (OFAC).
Hackathoner may restrict, suspend or cancel access where reasonably necessary to comply with applicable sanctions laws or regulations.
 
 

Age Requirement

Hackathoner is intended solely for users who are at least 18 years of age. By using the Site or purchasing a membership, you represent and warrant that you are 18 years of age or older.
If you are under 18 years of age, you may not create an account, purchase a membership or use Hackathoner.
 
 

Intellectual Property

All content included as part of the Hackathoner service — including text, graphics, logos, images, video content, audio content, Campus materials, lessons, Business Paths, frameworks, templates, tools and software — is the property of Taifun Kemerci (also written as Tayfun Kemerci) / Hackathoner or its content licensors and is protected by applicable copyright, trademark and other intellectual property laws.
 
Subject to these Terms and an active membership, you are granted a personal, limited, non-exclusive, non-transferable and revocable licence to access and use the Hackathoner platform and its content for your own educational purposes. Where expressly permitted, you may apply lessons, frameworks and templates to your own projects. This licence does not include the right to:
• Copy, reproduce, distribute or publicly display any content, except where expressly permitted by Hackathoner;
• Modify, adapt, translate or create derivative works from any content for redistribution, resale or use by third parties;
• Sell, resell, sublicense or commercially exploit Hackathoner content as a standalone product or service;
• Share, transfer or provide access to your account or membership content to any third party;
• Record, download or store Campus content, lessons or other membership resources except where personal offline viewing is expressly permitted by Hackathoner.
 
Any unauthorised use of Hackathoner content may result in suspension or termination of membership access, subject to applicable law and mandatory consumer rights, and may expose you to legal liability.
 
 

No Unlawful or Prohibited Use

As a condition of your use of Hackathoner, you agree not to use the Site, membership, account or content for any unlawful purpose or in any manner prohibited by these Terms.
You must not use Hackathoner in a way that could damage, disable, overburden, impair or compromise the security of the Site or platform; interfere with another person’s use of the Site; attempt to gain unauthorised access to any account, system or data; or use the platform to violate applicable laws, regulations or third-party rights.
 
 

Links to Third-Party Sites

Hackathoner may contain links to third-party websites, services, products or software. These third-party sites are not owned or controlled by Hackathoner, and we are not responsible for their content, availability, privacy practices, terms of service or security.
 
The inclusion of a third-party link does not constitute an endorsement, guarantee or recommendation of that third party unless expressly stated otherwise. Your use of third-party sites is subject to their own terms, policies and applicable laws.
 
 

Disclaimer of Warranties

To the fullest extent permitted by applicable law, Hackathoner is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. This includes, to the extent permitted by law, implied warranties of merchantability, fitness for a particular purpose and non-infringement.
 
We do not warrant that the Site or membership platform will be uninterrupted, error-free, secure or free of viruses or other harmful components. Nothing in these Terms limits or excludes any mandatory consumer rights or warranties that cannot lawfully be limited or excluded.
 
 

Limitation of Liability

To the fullest extent permitted by applicable law, Hackathoner and its operators shall not be liable for indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Site, membership or content.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for intent, gross negligence, injury to life, body or health, fraud, liability under applicable product-liability law, or mandatory consumer rights.
In cases of ordinary negligence, Hackathoner’s liability is limited to breaches of essential contractual obligations and to the foreseeable damage typically arising from such a breach, to the extent permitted by applicable law.
 
 

Earnings Disclaimer

Hackathoner does not guarantee any specific financial result, income level or business outcome. Any examples, illustrations or discussions of business models are provided for educational and informational purposes only and must not be understood as typical, expected or guaranteed results.
Results vary from person to person and depend on many factors, including the time, effort and consistency you apply; your prior knowledge, skills and experience; your available resources; your implementation decisions; and market conditions. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict-of-law rules, to the extent permitted by applicable law.
If you are a consumer habitually resident in the European Union, any mandatory consumer protection provisions of your country of residence remain applicable. Nothing in these Terms affects your right to bring a claim before a court that has jurisdiction under applicable mandatory law.
Any dispute arising out of or in connection with these Terms shall be subject to the courts having jurisdiction under applicable law.
Hackathoner is not obliged to participate in dispute-resolution proceedings before a consumer arbitration board. We may consider participation in individual cases at our discretion.

 
 

Tax Information

VAT Identification Number: DE446335963 (issued pursuant to § 27a of the German Value Added Tax Act / Umsatzsteuergesetz).
Hackathoner displays its membership prices in US Dollars (USD). Where applicable, VAT or other legally required taxes may be added at checkout based on your country of residence and the relevant tax rules for digital services. Your invoice will reflect any applicable tax amount.
Customers outside the European Union are responsible for any taxes, duties or charges that may apply in their jurisdiction.

 
 

Changes to These Terms

We may amend these Terms where reasonably necessary due to legal, regulatory, technical, security or operational reasons, or to reflect changes to the Hackathoner membership and its digital resources.
If a change is material, we will notify you by e-mail or by a clear notice on the Site at least 30 days before the change takes effect, unless a shorter period is required for urgent legal or security reasons. Where a material change adversely affects you, we will explain any applicable right to cancel your membership before the change takes effect.
Your continued use of Hackathoner after the effective date of an updated version of these Terms constitutes acceptance only to the extent permitted by applicable law. Nothing in this section limits any mandatory consumer rights.
