Agreement Between User and Hackathoner
Welcome to Hackathoner. The Hackathoner website (the “Site”) is operated by Tayfun Kemerci, Paulinenstr. 23, 74076 Heilbronn, Germany (“Hackathoner”, “we”, “us”, or “our”). Hackathoner is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of Hackathoner constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for your reference.
Service Overview
Hackathoner is an educational membership platform offering video courses, live coaching sessions, community access, and related digital educational content. All content is provided for educational and informational purposes only. We take great pride in offering high-quality educational content, personalised support, and a positive community designed to help our members develop practical online business skills.
Hackathoner is specifically designed for individuals who are dedicated to investing time and effort to develop real skills and build online income streams. Access to our services is exclusive to members who accept and adhere to these Terms.
Privacy

Visiting Hackathoner or sending emails to us constitutes electronic communications. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account. Hackathoner is not responsible for third-party access to your account resulting from theft or misappropriation of your credentials. We reserve the right to refuse or cancel service, terminate accounts, or remove or edit content at our sole discretion. You are responsible for providing accurate and complete information during registration and account management.
Membership and Payment
Your Hackathoner membership provides access to educational video courses, live coaching sessions, community features, and related digital content as described on the membership page at the time of purchase.
Billing: By subscribing to Hackathoner, you authorise us to charge your selected payment method the applicable membership fee in USD at the start of each billing cycle. All prices are displayed in US Dollars (USD). Applicable taxes may be added depending on your country of residence.

Prices are subject to change. We will notify you at least 30 days in advance of any price changes. Continued use of the membership after a price change constitutes your acceptance of the new price.
We accept payments via Visa, Mastercard, American Express, and other payment methods as displayed at checkout. All transactions are processed in USD.
EU Customers: If you are located in the European Union, applicable VAT will be added to your subscription price in accordance with EU VAT regulations. Your invoice will reflect the applicable VAT rate for your country.
Cancellation Policy
You may cancel your membership at any time by logging into your membership portal and updating your subscription settings, or by contacting our support team at support@hackathoner.com.
Cancellations must be made before the next billing cycle to avoid being charged for the subsequent period. Upon cancellation, your access to membership content will continue until the end of the current paid billing period. No partial refunds are issued for unused portions of a billing period.
Refund Policy
Due to the digital nature of our products and services, and the immediate access granted upon purchase, we do not offer refunds as a general policy. Once access to digital content has been granted, the purchase is considered final.
We understand that exceptional circumstances may arise. If you believe your situation warrants an exception, please contact our support team at support@hackathoner.com within 7 days of your purchase. Refund requests are evaluated on a case-by-case basis at our sole discretion.
EU Consumer Rights: If you are a consumer located in the European Union, you may have a statutory right of withdrawal within 14 days of purchase under EU consumer protection law. However, by accessing the digital content immediately upon purchase, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once access has been granted, in accordance with Article 16(m) of EU Directive 2011/83/EU.
Prohibited Transactions
Hackathoner does not conduct business with or provide services to any countries or individuals sanctioned by applicable international sanctions authorities, including but not limited to the EU sanctions list, the UN Security Council sanctions list, and the US Office of Foreign Assets Control (OFAC).
Age Requirement
Hackathoner is intended for users who are at least 18 years of age. By using this Site, you represent and warrant that you are 18 years of age or older. If you are under 18, you may not use Hackathoner without the express consent of a parent or legal guardian, and such use remains subject to these Terms.
Intellectual Property
All content included as part of the Hackathoner service — including but not limited to text, graphics, logos, images, video content, audio content, course materials, templates, and software — is the property of Tayfun Kemerci / Hackathoner or its content licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
You are granted a personal, non-exclusive, non-transferable, revocable licence to access and use the Hackathoner platform and its content solely for your own personal, non-commercial educational purposes. This licence does not include the right to:
•Copy, reproduce, distribute, or publicly display any content
•Modify, adapt, translate, or create derivative works from any content
•Sell, resell, sublicense, or commercially exploit any content
•Share, transfer, or provide access to your account to any third party
•Record, download, or store course videos or live sessions for any purpose other than personal offline viewing where explicitly permitted
Any unauthorised use of Hackathoner content may result in immediate termination of your membership without refund and may expose you to legal liability.
No Unlawful or Prohibited Use
As a condition of your use of the Site, you agree not to use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site.
Community and Communication Standards
Hackathoner provides community features including forums, group chats, and live sessions. By participating in these features, you agree to conduct yourself in a respectful, constructive, and lawful manner. You agree not to post content that is defamatory, abusive, harassing, threatening, obscene, fraudulent, or otherwise objectionable. Hackathoner reserves the right to remove any content and terminate the membership of any user who violates these standards, without refund.

Hackathoner may contain links to third-party websites and services. These sites are not under our control and we are not responsible for their content, privacy practices, or terms of service. The inclusion of any link does not imply endorsement by Hackathoner. You access third-party sites at your own risk and are responsible for complying with their terms of service.
Disclaimer of Warranties
Hackathoner is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
Limitation of Liability
To the fullest extent permitted by applicable law, Hackathoner and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or its content, even if advised of the possibility of such damages. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid for your membership in the 12 months preceding the claim.

Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. For consumers located in the European Union, mandatory consumer protection provisions of your country of residence shall apply in addition to German law.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Heilbronn, Germany, unless mandatory consumer protection law in your country of residence requires otherwise.
EU Online Dispute Resolution: The European Commission provides an online dispute resolution platform accessible at https://ec.europa.eu/consumers/odr. We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board, but we are willing to do so in individual cases.

Hackathoner charges prices in USD. EU customers may be subject to VAT in accordance with applicable EU VAT rules on digital services. Non-EU customers are responsible for any applicable taxes in their jurisdiction.
Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on the Site at least 14 days before the changes take effect. Your continued use of Hackathoner after the effective date of any changes constitutes your acceptance of the revised Terms.
